How long do I have to file a bicycle accident claim in Las Vegas? 

Every personal injury case is subject to a time limit, known as the statute of limitations. Once this time frame has passed, the plaintiff loses their right to file. 

In general, the statute of limitations for personal injury cases in Nevada is two years from the date of the accident. It is important to contact an attorney as soon as you believe you have a case, because the personal injury process can move slowly, taking months or even years. 

Who is responsible for my bicycle accident? 

Nevada follows a rule of modified comparative negligence for car accidents. This means that you can recover compensation for your damages even if you are found partially responsible for the accident, as long as you are not more than 50% at fault. 

Fault will be assigned as a percentage—for example, you may be assigned 25% of the blame, while the motorist is assigned 75%. In this instance, your potential settlement would be reduced by 25%, due to your level of responsibility.

File a police report 

Ask that a police officer be dispatched to the scene to file a report. Many insurance companies require a police report before they will approve any claims.
